Terms & Conditions of Use

Welcome to CarmenBody. These terms and conditions govern the use of Services provided by CarmenBody.  By accessing this site and/or participating in our Services you are indicating your acknowledgment and acceptance of these terms and conditions of use. These terms of use are subject to change by CarmenBody at any time at its sole discretion. Your continued use of the services provided by CarmenBody after any such changes are implemented constitutes your acknowledgement and acceptance of these changes so we encourage you to consult these terms of use regularly.  

 

1. You are participating in yoga classes and/or educational workshops which may be offered in the physical location of the Studio, at a Retreat, or offered online by digital media or platforms.

 

2. You recognise that you must be in adequate physical and mental health to participate and understand that Yoga may require strenuous physical exertion which may cause or aggravate a physical injury or medical condition.

 

3. It is your responsibility to consult with a physician prior to and regarding your participation in Yoga. You have taken the physician’s advice and understand that the Teacher reserves the right to refuse your participation on medical, fitness or any other grounds.

 

4. You are aware that you could experience muscle, back, neck and other injuries as a result of your participation in Yoga.  You understand your physical limitations and are sufficiently self-aware to stop or modify your participation before you become injured or aggravate a pre-existing injury.

 

5. In consideration of your participation in our Yoga classes and educational workshops, you agree to assume full responsibility for any risks, injuries or damages, known or unknown, which you might incur as a result of participating, and will not hold CarmenBody or teachers responsible for any injuries that you may sustain as a result.

 

6. Dispute Resolution

If a dispute arises out of or relates to this contract, or the breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by Peacemaker Equity under the Peacemaker Equity Rules before resorting to arbitration.The mediation will be conducted in person at a specified location or via video conference or phone call and all documentation/evidence relating to the dispute and any negotiation which has taken place is to be provided via email to info@peacemakerequity.com at least 7 days before the mediation can commence.The parties agree to waive their right to sue or litigate in any public court and agree to try in good faith to informally resolve any dispute via negotiation and mediation for at least 30 days before starting arbitration.

 

7. You hereby understand that the Teacher may photograph or video your participation in Yoga and consent to the use of such images and videos on its website or social media platform for advertising and promotional purposes with no charge. Please advise if you prefer your image not to be used.

 

8. You will not participate in yoga classes if you are feeling unwell.

 

9. Consideration of a refund is at the sole discretion of the administration team
